Procedure:
In accordance with Section 41 of the Workplace Relations Act, 2015 [Section 6 of the Payment of Wages Act 1991] following the referral of the complaint(s)/dispute(s) to me by the Director General, I inquired into the complaint(s)/dispute(s) and gave the parties an opportunity to be heard by me and to present to me any evidence relevant to the complaint(s)/dispute(s).
Summary of Complainant’s Case:
The claimant was employed as a cleaner with the respondent from the 6th.Oct.2016 to the 8th.Dec.2016 when she terminated her employment as the respondent was not paying her.She cleaned accommodation for air bnb rentals and payment was made sporadically and always in cash.The claimant had submitted all of her documentation to the respondent to register her with Revenue but despite repeated reminders she was not registered.Ultimately when the claimant complained about non payment of her wages , she submitted that the respondent replied that he knew where she lived and she perceived this as a threat and moved accommodation. The claimant submitted that the respondent was in breach of the Act for failing to pay her outstanding wages of €510.25. |

Decision:
Section 41 of the Workplace Relations Act 2015 requires that I make a decision in relation to the complaint(s)/dispute(s) in accordance with the relevant redress provisions under Schedule 6 of that Act.
On the basis of the uncontested evidence of the claimant , I find the complaint to be well founded and require the respondent to pay the claimant €510.25 within 42 days of the date of this decision. |
